Welcome to Moments. These Terms of Service ("Terms") govern your use of the Moments mobile application and related services ("the Service") operated by Yazh Studio ("we", "us", "our").
1. The Service
Moments is a platform that allows users to:
- Create collaborative digital moments for special occasions
- Invite others to contribute messages, photos, and videos
- Reveal completed moments to recipients
- Save occasions and receive reminders
- Receive push notifications about moment activity
2. Eligibility
You must be at least 13 years of age to use Moments. If you are under 18, you represent that you have your parent or guardian's consent to use the Service.
3. Accounts
3.1 Registration
You may sign in using Google authentication. By signing in, you authorize us to access your name, email address, and profile photo from your Google account.
3.2 Account Security
You are responsible for maintaining the security of your account. You agree to:
- Not share your account credentials with others
- Notify us promptly if you suspect unauthorized access
- Accept responsibility for all activity under your account
3.3 Guest Access
Certain features (contributing to moments, viewing revealed moments) are accessible via invitation links without an account. These are governed by token-based access with device verification.
4. User Content
4.1 Your Content
You retain ownership of all content you create and upload to Moments, including text messages, photos, and videos ("User Content"). By uploading content, you grant us a limited, non-exclusive license to store, display, and transmit that content solely for the purpose of providing the Service to you and the other participants of the moment.
4.2 Content Responsibility
You are solely responsible for the content you upload. You represent and warrant that:
- You own or have the necessary rights to the content you upload
- Your content does not infringe on the intellectual property or privacy rights of others
- You have obtained consent from any individuals depicted in photos or videos
4.3 Prohibited Content
You agree not to upload or share content that:
- Is unlawful, harmful, threatening, abusive, harassing, defamatory, or obscene
- Contains sexually explicit material involving minors
- Promotes violence, discrimination, or hatred against any group
- Contains malware, viruses, or malicious code
- Impersonates another person or misrepresents your identity
- Violates any applicable law or regulation
5. Invitations & Contributors
5.1 Inviting Contributors
When you create a moment and invite contributors, you represent that:
- You have a legitimate reason to contact each invited person
- You will not use the invitation system for spam, marketing, or unsolicited messages
- You accept responsibility for the invitations sent from your account
5.2 Contributor Consent
Contributors who receive an invitation link and submit content do so voluntarily. By submitting a contribution, contributors agree to have their content included in the moment and shared with the receiver and other authorized viewers upon reveal.
5.3 Receiver Consent
By providing a receiver's email address, you acknowledge that the receiver will receive communications from the Service related to the moment you created.
6. Moments Lifecycle
6.1 Status Transitions
Moments follow a defined lifecycle: Preparing → Published → Locked → Revealed → Archived. As the creator, you control these transitions.
6.2 Locking Contributions
When you lock a moment, contributors who have not yet submitted their content will be removed and their access tokens will be automatically revoked. This action cannot be undone.
6.3 Revealing
When you reveal a moment, all contributions become visible to the receiver and to contributors with view access. You should only reveal a moment when you are satisfied with the collected content.
7. Access Tokens & Security
Access to moments for contributors and receivers is managed through unique, time-limited tokens. You agree to:
- Not share access tokens or invitation links publicly or with unauthorized persons
- Not attempt to circumvent token validation, device verification, or rate limiting
- Not attempt to access moments or data you are not authorized to view
8. Push Notifications
By enabling push notifications, you consent to receive notifications about:
- New contributions to your moments
- Invitations to contribute
- Moment reveals
- Thank-you notes from receivers
- Occasion reminders you have configured
You can disable push notifications at any time through your profile settings or your device's system settings.
9. Acceptable Use
You agree not to:
- Use the Service for any illegal purpose
- Attempt to gain unauthorized access to other users' accounts or data
- Interfere with or disrupt the Service or its infrastructure
- Use automated tools (bots, scrapers) to access the Service
- Reverse engineer, decompile, or disassemble any part of the Service
- Use the invitation system to send unsolicited or spam messages
- Upload content that exceeds the specified size limits (100MB per file)
- Create multiple accounts for abusive purposes
10. Intellectual Property
10.1 Our Property
The Moments app, its design, logos, branding, and underlying technology are the intellectual property of Yazh Studio. You may not copy, modify, distribute, or create derivative works of the Service.
10.2 Your Property
You retain all rights to the content you upload. The license you grant us is limited to operating the Service and terminates when you delete your content or account (subject to data retention as described in our Privacy Policy).
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that:
- The Service will be uninterrupted, error-free, or secure
- Content uploaded by users will be preserved indefinitely
- Push notifications will be delivered in all circumstances
- The Service will meet your specific requirements
12. Limitation of Liability
To the maximum extent permitted by law, Yazh Studio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:
- Your use of or inability to use the Service
- Loss of data or content
- Unauthorized access to your account
- Any third-party content or conduct on the Service
Our total liability for any claim arising from the Service shall not exceed the amount you have paid us in the 12 months preceding the claim, or INR 1,000, whichever is greater.
13. Termination
13.1 By You
You may stop using the Service at any time. You may request account deletion by contacting us.
13.2 By Us
We may suspend or terminate your account if you violate these Terms, engage in abusive behavior, or for any other reason at our discretion. We will make reasonable efforts to notify you before termination, except in cases of severe violations.
13.3 Effect of Termination
Upon termination, your right to use the Service ceases immediately. Moments you created remain accessible to other participants (receivers and contributors with existing access). Content you contributed to others' moments will remain in those moments.
14. Changes to These Terms
We may update these Terms from time to time. We will notify users of significant changes through the App or at our website. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in Chennai, Tamil Nadu, India.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
